Version 2.0
TERMS AND CONDITIONS
1.Definitions and Terms - "Original Copyright Holder" refers to Neosynapse, Incorporated, a Delaware company.
- The "Original Copyright Holder's Contact Email Address" refers to the Internet email address
derived-works@neosynapse.net.
- "License" refers to this license document.
- "Property" refers to any work of intellectual property covered by this License.
- "Reserved Name" refers to the name used to identify the Property to its audience. The Reserved Name for the Property covered by this License is "istring" or any variation thereof.
- "Product" refers to anything that uses the Property or a Derived Work covered by this License, including but not limited to: publications, software applications, libraries, and frameworks.
- A "Commercial Product" is a Product for which you charge a fee.
- "Derived Work" refers to any modified version of the Property, whether in source, binary, compiled or any other format. Modifications may be of the form of deletions, additions, or changes to the Property. Only modifications of the Property or a Derived Work are Derived Works. Specifically, a Product does not become a Derived Work by merely linking to or using the Property or a Derived Work.
- A "Previous Contributor" with respect to a given Derived Work is any person or group in the set of all persons or groups who either originally released the Property upon which the derived work is based, or who distributed an earlier Derived Work upon which the current Derived Work is based.
- A "Recipient" is a person to whom you distribute a Derived Work, whether or not as part of another Product, and whether or not the Product is Commercial.
- "Original Text" refers to the human-readable version of a Derived Work. In the case of software, this refers to uncompiled source code text.
2. You do not have to accept this License, since you did not sign it. However, nothing else gives you the right to use the Property or any Derived Works. Therefore, if you do not accept and abide by the terms of this License, you may not copy, modify, sublicense, link with, or use the Property or any Derived Work. This License is the complete statement of your rights with regard to the Property or Derived Work. You may not copy, modify, sublicense, link with, or use the Property or Derived Work except as provided in this License.
3. The Original Copyright Holder grants you a perpetual, non-exclusive, world-wide license to use this Property in any Product, including a Commercial Product, for any purpose, without paying a royalty, and without restrictions other than those specified in this License.
4. You assign copyright for any Derived Work which you distribute to the Original Copyright Holder. The Original Copyright Holder, in turn, grants you the right to use the Derived Work under the terms of this license. This License is not "viral," which means the terms of this license do not apply to Products that merely link to this Property or Derived Works. The terms of
this license only apply to the Property or the Derived Works themselves.
5. You must submit the Original Text of all Derived Works to the Original Copyright Holder's Contact Email Address prior to the initial distribution of the Derived Work to a third party.
6. You must offer to make available the Original Text of any Derived Work under the terms of this License to those to whom you distribute the Derived Work, regardless of whether you distribute the Derived Work by itself or as part of a larger Product. If the Recipient accepts this offer, you must deliver the Original Text of the Derived Work at the same time and in the
same manner and medium in which you provide the Derived Work itself, or in some other way and/or time that is mutually agreeable to you and the Recipient. You may charge a fee for the Derived Work, but you may not charge an additional fee, or require any other additional actions in order to deliver the Original Text of the Derived Work.
7. When you distribute this Property or any Derived Works, you must include a copy of this license so that licensees know their rights and obligations with regard to the Property or Derived Work. You must also preserve any copyright notices in the source code, and you must include the copyright notices prominently in the documentation for your Product, as well as, if practicable, in your Product's "splash screen" or startup message, if any. If your Product's splash screen and/or startup message omit all copyright notices, then you may omit the copyright notices for the Property or Derived Works from these locations as well.
8. Each time you redistribute the Property or any Derived Work, the recipient automatically receives a license from the Original Copyright Holder to use the Property or Derived Work subject to the terms and conditions of this License. You may not impose any further restrictions on the recipients' exercise of the rights granted herein. You are not responsible for enforcing compliance by third parties with this License.
9. Unless previously agreed to in writing by the Original Copyright Holder, when you distribute, market, or provide information about a Derived Work to third parties, you may used the Reserved Name solely for the purpose of indicating that the Derived Work is derived, directly or indirectly, from the Property. Unless previously agreed otherwise in writing by the relevant Previous Contributors, when you use the Reserved Name for the purpose authorized in this section, you must state in a clear and prominent way that:
- The Derived Work contains modifications provided by you;
- No Previous Contributor in any way endorses the Derived Work which you are distributing; and that
- To the extent you offer support or warranties of any kind, such
support and/or warranties are offered exclusively by you and not by any Previous Contributor.
10. If legal restrictions are placed on you that prevent you from distributing this Property or Derived Works under the terms of this License, then you may not distribute such Property or Derived Works at all. Such legal restrictions may include, without restriction, contractual agreements, court judgments and patent infringement allegations.
11. You may offer a warranty and/or support contract for the Property or for your Derived Work, provided you make clear that such warranties and/or support contracts are offered exclusively by you and not by any Previous Contributor.
12. If any competent jurisdiction finds that one or more clauses of this License are unenforceable or invalid, then all rights to use this Property or Derived Work under this License are withdrawn in that jurisdiction.
13. NO WARRANTY. EXCEPT WHEN OTHERWISE STATED IN WRITING, THE PROPERTY IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROPERTY OR DERIVED WORK IS WITH YOU. SHOULD THE PROPERTY OR DERIVED WORK PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. IF APPLICABLE LAW REQUIRES A
WARRANTY OF ANY KIND, THEN ALL RIGHTS TO USE THIS PROPERTY OR DERIVED WORK ARE WITHDRAWN IN THAT JURISDICTION.
14. IN NO EVENT UNLESS AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE PROPERTY OR DERIVED WORK AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROPERTY OR DERIVED WORK (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PROPERTY OR DERIVED WORK TO OPERATE WITH ANY OTHER PRODUCTS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF APPLICABLE LAW IN A JURISDICTION HOLDS INOPERATIVE OR IN ANY WAY CONTRAVENES THIS CLAUSE, THEN ALL RIGHTS TO USE THIS PROPERTY OR DERIVED WORK ARE WITHDRAWN IN THAT JURISDICTION.
